Who Pays the Estate Agent's Commission When Buying in Spain?

In Spain, it is almost always the seller who pays the estate agency's commission, not the buyer. For British buyers used to different conventions, this is good news, but the contract still deserves a careful read before you sign anything.

Who is behind this page. Sókerim is a Spanish real-estate agency (Lyrio Home Solutions, S.L.) with offices in the Madrid region and Alicante and a network of about 1,000 collaborating agencies across Spain. We help people who live abroad find, buy and manage property in Spain, in English, from the first search to the keys.

The short answer: the seller pays

Spanish property transactions work differently from some other markets you may know. The estate agency is normally instructed by the seller, who signs a listing agreement (nota de encargo) setting the agency's fee as a percentage of the final sale price. That fee is deducted from the seller's proceeds at completion, so as a buyer you are not expected to add an agency commission on top of the purchase price.

This matters when you are budgeting from the United Kingdom, because it means the price you negotiate is broadly what you pay, before the separate taxes and administrative costs described below. It does not mean buying in Spain is free of fees, only that the agent's commission specifically is not one of them for most resale transactions.

Rule of thumb: if an agency asks you, the buyer, to sign anything that creates a direct payment obligation to them, read it twice and ask your lawyer before signing.

What this means for you as a buyer

Because the agency's fee is agreed with the seller, you should not usually see a separate commission line added to your completion costs. What you will see are the taxes and professional fees linked to transferring the property into your name, which exist regardless of who sold it to you.

There are exceptions worth knowing. Some buyers, particularly those purchasing from abroad, choose to work with a buyer's agent who searches and negotiates on their behalf for a separate fee agreed directly with the buyer. This is a different arrangement from the seller's listing agency and should always be set out in writing before any search begins, with the fee, the scope of work and the circumstances under which it is due clearly stated.

Always ask in writing who the agency is working for and whether any fee could ever fall on you if the deal does not go ahead as planned.

Off-market properties and collaborating agencies

Spain's property market includes a large informal network of agencies that share listings with one another, sometimes before a property reaches public portals. Sókerim works within a network of around 1,000 collaborating agencies across Spain, which means some opportunities reach our team before they are widely advertised.

For buyers living outside Spain, we handle the search, viewings in person or by video, negotiation, checks on the property, and coordination with your lawyer, the notary and your bank, all in English. We also help with the NIE application and opening a Spanish bank account, and we stay involved after completion for matters such as utilities, community fees and keys.

NIE

Tax number

Every foreign buyer needs a Spanish NIE before signing at the notary; we help you apply for it.

3 %

On future sale

If you later sell as a non-resident, the buyer withholds 3% of the price on account of your Spanish tax.

90/180

Visa-free stays

UK citizens can stay in Spain up to 90 days in any 180 without a visa; longer stays require a visa or residence permit.

What UK buyers should prepare

None of these documents relate to the agency's commission, but lenders, notaries and lawyers will ask for them, so it helps to have them ready early. Spain and the United Kingdom have a double taxation agreement, and a local tax adviser should confirm exactly how any Spanish rental income or gains must be declared both in Spain and to HMRC.

Because the United Kingdom uses the pound rather than the euro, build exchange-rate movements and transfer costs into your overall budget, separately from any agency or tax figure quoted to you in euros.

A note on the Golden Visa

Spain's Golden Visa for property investors ended on 3 April 2025 and is no longer available to new applicants, including buyers from the United Kingdom. Anyone planning to live in Spain for longer than 90 days in any 180-day period should look into the standard visa or residence routes instead.

If you would rather hand the whole process to us

Some clients prefer a managed approach: we find a property with renovation potential, you buy it in your own name, our own renovation team carries out the works, and we sell it or rent it out for you for agreed fees. Since 2022 our group has bought, renovated and resold 19 homes for investor projects, with a median renovation budget of 22% of the purchase price.

These are past results from our own accounts, not a promise. Returns on any property project vary, can be lower than hoped or negative, and past performance never predicts future results.

If you live in the United Kingdom

Spain is a relatively short flight away from most UK airports, making regular visits to a Spanish property straightforward for owners based in Britain. Many British buyers are drawn to Spain for its climate, coastal lifestyle and established expatriate communities. One practical point to bear in mind is that Spanish inheritance law differs from UK rules, so it is worth taking specific advice on how it may affect the property and one's estate. Currency movements between sterling and the euro can also affect the overall cost of purchase and ongoing expenses.

What a Spanish bank will usually ask you for

Tax at home and in Spain

Spain and the United Kingdom have a double taxation agreement in place, and a local tax adviser should confirm how rental income or gains from Spanish property must be declared and reported to HMRC.

Staying in Spain

As the United Kingdom is no longer an EU member state, British citizens may stay in Spain for up to 90 days in any 180-day period without a visa, and must apply for a visa or residence permit for longer stays.

Since the United Kingdom uses the pound sterling (GBP) rather than the euro, buyers should factor in exchange-rate movements and currency conversion costs when paying for a property or transferring funds to Spain.

Frequently asked questions

As a UK buyer, will I ever be asked to pay the estate agent directly?

Usually not for a standard resale purchase, since the seller pays the listing agency. The exception is if you separately hire a buyer's agent to search and negotiate on your behalf; in that case, the fee and terms should be agreed with you in writing before any work begins, and it is entirely separate from the seller's agency arrangement.

Why would my lawyer want to see the agency's listing agreement?

A lawyer checks who the agency legally represents and whether any clause could create an obligation for you, the buyer, such as a fee if the deal falls through or if you later buy directly from the owner. This protects you from unexpected costs unrelated to the taxes and notary fees you already expect to pay.

Are there extra costs specific to buying as a UK resident?

The main ones are currency conversion costs and exchange-rate movements when transferring pounds into euros, plus the time needed to gather UK documents such as payslips, tax returns and bank statements. The transfer tax, notary and registry fees apply to all buyers equally, regardless of nationality.

Is the Golden Visa still an option for property investors from the UK?

No. Spain's Golden Visa programme for property investment ended on 3 April 2025 and is no longer open to new applicants. UK citizens can still stay in Spain up to 90 days in any 180 without a visa, but longer stays now require a standard visa or residence permit application.

Do I need a Spanish bank account before the agency fee or taxes are settled?

You will need an NIE and usually a Spanish bank account to pay purchase costs, complete the deed before the notary and register the property. These are separate from any agency fee, which the seller settles with the agency directly; we can help you arrange both the NIE and the account in advance.
