Do You Need a Structural Survey Before Buying in Spain?

Foreign buyers often assume a structural survey is automatic in Spain, the way it is in the United Kingdom. In Spain, it is not required by law, yet it remains one of the clearest ways to understand a property's real condition before you commit your money.

Who is behind this page. Sókerim is a Spanish real-estate agency (Lyrio Home Solutions, S.L.) with offices in the Madrid region and Alicante and a network of about 1,000 collaborating agencies across Spain. We help people who live abroad find, buy and manage property in Spain, in English, from the first search to the keys.

A Habit Brought From the UK, Not a Spanish Legal Requirement

In the United Kingdom, a RICS survey is so embedded in the buying process that many assume Spain works the same way. It does not. Spanish law requires a notary to confirm that a property's legal title is clean and that it is correctly registered, but a notary has no obligation, and no role, in checking whether the roof leaks, the wiring is safe or a wall has structural movement.

That gap is exactly where an independent technical survey, carried out by an architect or aparejador rather than a lawyer, earns its place. For older houses, village properties and anything described as having renovation potential in Spain, it can be the difference between a sound purchase and a costly surprise discovered only after the deeds are signed.

A notary in Spain confirms that the legal title is clean, not that the building itself is sound; those are two separate checks.

Why the Notary and Land Registry Do Not Check the Building

When you sign before a Spanish notary and the purchase is later recorded at the Land Registry, what is being verified is ownership, charges and legal boundaries. A lawyer, usually hired by foreign buyers though not compulsory, extends that check into planning status and outstanding debts tied to the property. None of these professionals inspects beams, damp or foundations.

That technical gap matters more in some buildings than others. Many older properties in Spain fall under periodic municipal building-inspection schemes, and a seller should be able to show whether the relevant certificate exists. An independent surveyor can confirm what that certificate does, and does not, cover.

Ask early whether the property has ever needed a municipal building-inspection certificate, and whether any defects noted were resolved.

22 %

Median renovation share

Across the 19 homes our group has bought, renovated and resold for investor projects since 2022, the median renovation budget has represented 22 % of the purchase price, a past figure, not a forecast.

19

Homes renovated since 2022

Our own renovation team has worked on 19 completed projects, giving us a practical sense of which defects found in a survey are minor and which change a project's scope.

90/180

Visa-free stays for UK citizens

As the United Kingdom is no longer an EU member, British buyers may stay in Spain up to 90 days in any 180 without a visa, which shapes how a survey visit gets planned.

What an Independent Technical Survey Actually Reveals

A proper technical survey looks at structural walls, roof condition, damp, electrical installations, plumbing and any extension or reform that may not match what is registered. In rural fincas and older town houses in Spain, undeclared works are common enough to be worth checking specifically, since they can complicate a later sale or a tourist-rental licence application.

For buyers considering our managed investment service, the survey also feeds directly into the renovation budget our own team will later work from, so the figure you see before signing is grounded in the same inspection that guides the refurbishment plan.

Arranging a Survey From the UK, in Practice

Distance need not stop a careful check. Video viewings can be paired with a local surveyor's visit, and our team coordinates that alongside the lawyer, notary and bank steps that every non-resident buyer faces, including the NIE and a Spanish bank account. If financing is needed, our partner Colibrí Finances arranges mortgages for non-residents, though approval and terms are never guaranteed.

Because the United Kingdom uses the pound rather than the euro, it is also worth planning the currency conversion for the purchase price and later costs well ahead of the signing date, rather than leaving it to the final days.

After the Purchase: Tax and Residency Points UK Buyers Ask About

Owning a home in Spain brings yearly obligations: a non-resident income tax return (Modelo 210), municipal property tax (IBI) and community fees if the property is in a development. The double taxation agreement between Spain and the United Kingdom means a local tax adviser should confirm exactly how rental income or any future gain must also be reported to HMRC.

When you eventually sell, the buyer withholds 3 % of the price against your Spanish tax, and a municipal capital-gains tax (plusvalía) applies separately. It is also worth noting that the Spanish Golden Visa programme ended on 3 April 2025, so longer stays now require an ordinary visa or residence permit rather than that route.

If you live in the United Kingdom

Spain is a relatively short flight away from most UK airports, making regular visits to a Spanish property straightforward for owners based in Britain. Many British buyers are drawn to Spain for its climate, coastal lifestyle and established expatriate communities. One practical point to bear in mind is that Spanish inheritance law differs from UK rules, so it is worth taking specific advice on how it may affect the property and one's estate. Currency movements between sterling and the euro can also affect the overall cost of purchase and ongoing expenses.

What a Spanish bank will usually ask you for

Tax at home and in Spain

Spain and the United Kingdom have a double taxation agreement in place, and a local tax adviser should confirm how rental income or gains from Spanish property must be declared and reported to HMRC.

Staying in Spain

As the United Kingdom is no longer an EU member state, British citizens may stay in Spain for up to 90 days in any 180-day period without a visa, and must apply for a visa or residence permit for longer stays.

Since the United Kingdom uses the pound sterling (GBP) rather than the euro, buyers should factor in exchange-rate movements and currency conversion costs when paying for a property or transferring funds to Spain.

Frequently asked questions

Is an independent structural survey legally required when buying in Spain?

No. Spanish law does not require a structural survey before completion, unlike common practice in the United Kingdom. The notary checks legal title and registration, not the building's physical condition, so an independent technical survey is a separate, optional step that buyers arrange themselves if they want that reassurance.

Who is qualified to carry out a survey in Spain?

In Spain this work is usually done by an architect or aparejador (building technician) rather than a chartered surveyor as in the UK. They inspect structure, damp, roof and installations, and can flag any construction that does not match what is registered at the Land Registry.

Can a survey be arranged if I cannot travel from the UK before buying?

Yes, in many cases. A local technician can visit the property and report back with photos and findings, while you join viewings by video. This is common for non-resident buyers and can be coordinated alongside the lawyer, notary and bank steps needed for a purchase.

Does a technical survey also check planning permission or rental licences?

A structural survey focuses on the building's physical condition, not licensing. Checking planning status, any undeclared extensions, and whether a tourist-rental licence is possible is normally a lawyer's task, though findings from a survey, such as an unregistered extension, often prompt that separate legal check.

How should I transfer funds from the UK to pay for a survey and the purchase?

Since the United Kingdom uses pounds rather than euros, exchange-rate movement affects the final cost, so many buyers convert funds gradually or fix a rate ahead of key payment dates. A lawyer or gestoría can also confirm the documents your Spanish bank will expect for the transfer.
